The Decline of the Right to Silence: Recent Developments in England
In England the right to silence has been diminished, if not abolished, by the enactment of the Criminal Justice and Public Order Act 1994. In spite of the fact that the right existed as the suspect’s common law right in pre 1994 English Law, there was a great deal of argument for changing the existing law.
